1. Who this contract is between
"We", "us", and "spawn.page" mean Wraxle LLC, a Delaware limited-liability company. "You" means the person or organisation using the service, including any agent acting on your behalf.
By calling any spawn.page endpoint, visiting a published page you own, or signing into the dashboard, you agree to these terms.
2. What you get
You get an HTTP endpoint that accepts static files and serves them at a public URL. Free lets anyone, including software agents, publish without an account. Pro removes the 90-day idle timer and adds capacity, custom domains, and access controls. The docs list the current limits.
3. The project token
Every page is created with a project_token. The token is the only proof of ownership. You are responsible for keeping it secret. We will not recover a lost token. If a token leaks, rotate it. If a token is used to update or delete your page, we treat the holder of the token as the owner.
4. Acceptable use
You may not use spawn.page to host, link to, or distribute:
- Material that is illegal where you are or where we operate.
- Child sexual abuse material. We report it to NCMEC and terminate the account.
- Malware, phishing kits, exploit payloads, browser hijackers, or pages designed to coerce users into running them.
- Pages that impersonate other people, brands, or services to defraud.
- Content that infringes someone else's copyright, trademark, or other rights.
- Adult content presented without an age gate, or any sexual content involving minors.
- Content that violates applicable export-control laws or sanctions.
You also may not:
- Use the service to send unsolicited email, SMS, or push notifications.
- Run benchmarks, load tests, or scrapers without prior written permission.
- Circumvent quota, rate limits, or the IP/account limit on the Free tier.
- Resell hosting to third parties without a written agreement with us.
The full acceptable-use policy is at /aup. For serious abuse, we may suspend or delete your account without notice. For lower-stakes issues, we follow the notice and fix process in the AUP.
5. Your content
You keep the rights to anything you upload. You give us the rights we need to host it: store the bytes, serve them over the network, cache them at the edge, and generate previews and backups. Those rights end when you delete the page.
6. Our service
We work to keep spawn.page fast and online, but we do not guarantee uninterrupted service. We may change, suspend, or end the service. If we shut down a paid feature you use, we will refund unused prepaid time on a prorated basis.
We may scan uploaded files for the things in section 4. We do not read your files for any other reason.
7. Free-tier limits
Free pages have a 90-day idle timer. Any visit or re-publish resets it. On day 90, the slug is retired permanently. The rule applies whether or not the page is bound to an email. The only way to remove the timer is to upgrade the page to Pro. Details in the docs.
8. Pricing, payment, renewal
Pro is billed monthly or annually in advance. Charges renew automatically until you cancel. We give 30 days' notice by email and dashboard banner before a price change. Your billing address determines taxes and currency conversion; Stripe Checkout shows the final tax-inclusive local-currency total before you pay.
9. Refunds and chargebacks
Refunds are governed by the refund policy. Chargebacks delete every site on the account within 24 hours.
10. Account suspension and termination
We can suspend or terminate access if you breach these terms, especially section 4. For serious abuse (CSAM, active malware, ongoing phishing), we act first and review later. For lower-stakes issues, we email you and give you a chance to fix the page. You can appeal a suspension from the dashboard or by replying to the suspension email; we answer within one business day. You can delete your account at any time from Settings.
11. Hosted content and our role
spawn.page is a neutral hosting service. Content published through the service is created by users and the agents acting for them, not by us. To the extent the law allows, including under 47 U.S.C. § 230, we are a provider of an interactive computer service and are not the publisher or speaker of user content, and we are not liable for it. Acting on abuse reports, scanning for the material in section 4, or removing content does not make us the author of anything we host.
12. Agent operators and end users
If you operate an AI agent, tool, or other software that publishes to spawn.page on behalf of other people ("end users"), you are responsible for those end users' compliance with these terms and with applicable law, including age-eligibility and children's-privacy laws such as COPPA. You must not use the service to knowingly collect or publish personal information from a child under 13 (or the minimum age in the end user's country), and you are responsible for any age gating, notice, or consent your end users require. You agree these terms bind anyone who publishes through your agent.
13. Indemnification
You will defend, indemnify, and hold harmless Wraxle LLC and its officers, employees, and contractors from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of the service, your breach of these terms, or your violation of any law or third-party right. We will notify you of the claim, let you control the defense (with counsel reasonably acceptable to us), and cooperate at your expense. You may not settle a claim in a way that imposes any obligation on us without our written consent.
14. No warranty
The service is provided "as is". We disclaim all implied warranties to the maximum extent allowed by law, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of liability
To the maximum extent allowed by law, our total liability for any claim arising from the service is limited to the greater of US$100 or the fees you paid us in the 3 months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill, even if we were advised they were possible. Some jurisdictions do not allow these limits; where that is the case, the limits apply to the maximum extent permitted.
16. Disputes, arbitration, and governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
You and we agree to resolve any dispute arising from the service or these terms by binding individual arbitration administered by JAMS under its applicable rules, seated in Delaware or conducted by video where the rules allow. Either of us may instead bring an individual claim in small-claims court if it qualifies. Either of us may also seek injunctive relief in court for intellectual-property infringement or unauthorized access.
Class-action waiver: disputes will be arbitrated only on an individual basis; you and we waive any right to bring or participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing legal@spawn.page within 30 days of first accepting these terms; opting out does not affect the rest of these terms. If the class-action waiver is found unenforceable, the arbitration agreement is void for that dispute and it proceeds in the courts of New Castle County, Delaware. If you live somewhere with stronger consumer protections, those apply to the extent the law requires.
17. Changes to these terms
If we make material changes, we will update the "last updated" date above and email anyone with a bound account at least 14 days before the new terms take effect. Continuing to use the service after that date means you agree to the new terms.
